Open means that everybody is allowed to join.
If people don't want to, it's their problem.
People can also join, and not read the messages (as, unfortunately, happens
to me lately for domain-policy@internic, because of lack of time), but that
doesn't mean that the list is not open.
Maybe you mean that it's not all-inclusive.
